Softwerk S.A.P.I. de C.V. (hereinafter and interchangeably "we", "our", "us" and "Fotofacturas"), with its registered address at Calle Avenida Paseo del Centenario número 9580 interior 1708, Col. Zona Urbana Río Tijuana, Postal Code 22010, Tijuana, Baja California, Mexico, and Federal Taxpayer Registry (RFC) SOF210212NF4, welcomes you to https://fotofacturas.com/ (the "Site").

By accessing the Site, the User states that they accept all the terms, conditions, policies and notices set out herein, without limitation or restriction.

Likewise, all users warrant that (i) they are over 18 years of age, (ii) they have legal capacity to hold and exercise rights, (iii) they will use the Site in accordance with these Terms and Conditions; (iv) they will use the Site only on their own behalf; (v) all information they provide on this Site will be truthful, accurate, complete, current and will not infringe the rights of third parties (the "Users").

Similarly, by acquiring the Fotofacturas service (the "Service") the User accepts the following terms and conditions (the "Terms" or the "Terms of Service"), including all additional terms and conditions and the policies referenced in this document and/or available through the Site.

The Terms apply to all Users of the Site, including, without limitation, users who are browsers, vendors, customers and/or content contributors.

Any new feature or tool added to the Site will also be subject to the Terms of Service. You may review the most recent version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of the Terms of Service by posting updates and/or changes on the Site. It is the User's responsibility to review this page periodically to check for changes and updates. Continued use of or access to the Site after any changes are posted constitutes acceptance of those changes.

SECTION 1 - ELIGIBILITY AND SITE TERMS

By using the Site, the User declares that they are at least of legal age in Mexico, that is, 18 years old. The Site is only available to persons residing in Mexico.

The User may not use our products for any illegal or unauthorized purpose under applicable law in force. Breach or violation of any of these Terms will result in the immediate termination of the Services.

We reserve the right to refuse to provide the Service to anyone, for any reason and at any time.

The User agrees not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service or any contact on the Site.

The headings used in this agreement are included for convenience only and do not limit or affect these Terms.

SECTION 2 – ACCURACY AND COMPLETENESS OF INFORMATION

We are not responsible if the information available on this Site is not accurate, complete or current, as this Site may contain certain historical information. Historical information is not necessarily current and is provided for reference only. We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information on our Site, so the user agrees that it is their responsibility to monitor changes to our Site.

SECTION 3 - THE FOTOFACTURAS SERVICE

Through the Site, Fotofacturas generates the tax receipts or invoices corresponding to the receipts uploaded to the Site by the User, on behalf of and in the name of the User, subject to the User's prior acceptance of these Terms.

To provide the Service, Fotofacturasmay generate the corresponding invoice through the electronic invoicing portal of the merchant associated with each receipt or proof of purchase uploaded to the Site by the User or, where applicable, may contact the merchant by phone or email to generate the corresponding invoice on behalf of and in the name of the User.

To acquire the Services, the User must complete the following process:

  1. Create a username and password on the Site;
  2. Provide the billing information to complete registration on the Site;
  3. Verify their email address;
  4. Log in to the Site with their username and password;
  5. Upload a photograph of each of the receipts or proofs of purchase for which they require an invoice or tax receipt to be generated;
  6. Download the invoice through the Site or from the User's email.

SECTION 21 - CONTACT; INQUIRIES AND CLAIMS

If you have any question, concern, request for clarification or claim related to the Service, the Terms or the use of the Site, please contact us at hola@fotofacturas.ai, where we will resolve any concern within a maximum of 10 business days.

SECTION 22 - iOS SUBSCRIPTION ON THE APP STORE

When you subscribe through the App Store, 69.00 pesos will be charged to your iCloud account weekly. The subscription renews automatically unless canceled at least 24 hours before the end of the subscription period. You can cancel at any time from your iCloud settings.
